Trump’s defense team gears up for Senate trial, calls impeachment unconstitutional

The defense team of former president Donald Trump has called his impeachment trial unconstitutional. 

The newly appointed defense team was set to defend him against accusations of inciting a violent insurrection at the US Capitol. 

“It is denied that the 45th president of the United States ever engaged in a violation of his oath of office,” the defense attorneys wrote. “To the contrary, at all times Donald J. Trump fully and faithfully executed his duties as the president of the United States and at all times acted to the best of his ability to preserve, protect and defend the Constitution of the United States while never engaging in any high crimes or misdemeanors.”

Democrats argue that Trump rallied his supporters to storm the Capitol on January 6 although he had vowed to defend democracy and constitution of the United States. 

“President Trump’s conduct must be declared unacceptable in the clearest and most unequivocal terms,” the Democrats said. “This is not a partisan matter. His actions directly threatened the very foundation on which all other political debates and disagreements unfold. They also threatened the constitutional system that protects the fundamental freedoms we cherish.”

Trump has already left office and it is not clear whether there are any legal grounds for impeaching a president, whose tenure has finished. 

“The constitutional provision requires that a person actually hold office to be impeached,” Trump’s lawyers wrote.

The Republican president and his supporters have refused to accept victory of President Joe Biden in the 2020 presidential election.
