Good chance Trump may be indicted, Fox analyst says

A Fox News analyst says US President Donald Trump may be indicted in the wake of a case against his longtime fixer, Michael Cohen.

“This is the Southern District of New York. This is the oldest and most prestigious federal prosecutors’ office in the country. They would not make an allegation like that if they did not have corroborated evidence to support it," senior judicial analyst for the Fox News Channel Andrew Napolitano said on America Newsroom Monday, referring to a court filing from federal prosecutors released days earlier.

Nineteen women have accused the president of sexual misconduct or said they’ve had an extramarital affair with him. Trump has denied all of the allegations.

‘Secret indictment’

According to the prosecutors, Cohen, Trump's former personal attorney, "acted in coordination with and at the direction of" Trump when he made payments to silence two women about their sexual affairs with the New York millionaire amid the 2016 presidential election.

“And they cannot make an allegation like that unless they’re going to do something with it,” Napolitano said.

Yet, he noted that certain regulations are there at the Department of Justice when it comes to indicting a sitting president,

"The Justice Department has all kinds of rules and regulations," he said. "They have three legal opinions on whether a sitting president can be indicted. Two say no, and one says yes. But all three agree that if the statute of limitations is about to expire, then the government needs to do something to stop the running of the statute of limitations, which would mean a secret indictment, about which the public doesn’t know."

Cohen made payments during the 2016 campaign to two women – adult film actress Stormy Daniels and former Playboy model Karen McDougal – to silence them from speaking publicly about affairs they had with Trump.
