Mohamed Shinqiti’s speech on Sharia law

Dr. Mohamed el-Moctar Shinqiti

The understanding of Sharia today has been reduced to the legal aspect of Islam. In fact, Sharia is the whole religion: faith, worship, morality, legality, social values and so on. The dispute about Sharia comes from the misunderstanding that Islam’s meaning is reduced to the legal aspect. Sharia has to be understood based on original sources.

Most parts of Sharia are practiced in the majority of Muslim societies, but what is not implemented is the political values of Sharia. Political values such as giving people the right to choose their leaders, make them responsible, equality before law, taking the public office and wealth as a trust and not as personal property. These are the most important values, which have to be considered.

The distinction between the moral and legal aspects of Sharia is a great source of confusion; Sharia has both aspects. Worship is not a legal issue but a moral one. No application of Sharia is possible without social consensus.

It is important to know that a minority has no right to impose Sharia on the majority. When it is accepted by the majority, it can be law.
