Argentine federal judge rejects complaint against President Kirchner

Two weeks ago, the Argentine president was charged in a federal court for allegedly covering up the worst terrorist attack in the history of the country. The case kept the Argentine society on edge and sparked political turmoil but the allegations were quickly deemed unfounded by a federal court.

Judge Daniel Rafecas firmly dismissed all the accusations brought against President Kirchner by the late special Prosecutor Alberto Nisman who had accused the head of state of whitewashing the investigation of the AMIA Jewish community center bombing which took place back in 1994.
In his 63-page decision, Rafecas not only ruled out the case but also pointed out that the government exhausted all possibilities to enable the investigation into the attack to advance.

According to judge Rafecas, the criminal complaint originally filed by Nisman failed to meet the minimal conditions needed to launch a formal court investigation. However, the very conclusive ruling by the court has done little to dent the right wing mainstream media and the local Zionist organizations speculations about the President and they kept raising doubts against the government. Local commentators seem to be satisfied with the judicial decision.

The Federal Court ruling dismissing the charges against the president has been anticipated by jurists, as the claim filed by Nisman was full of groundless allegations even though the slain prosecutor had worked on the case for over a decade. It led government officials and experts to question if it had actually been written by Nisman or by pro-Israeli rogue intelligence agents with who he had a close relationship.

Prosecutor Pollicita, who revived the case after Nisman’s sudden death, refused to say whether he would appeal the decision. If he does, the case will be taken to the federal court of appeal were a new judge will be appointed in order to oversee the investigation.
